WEST FARGO — Two construction associations are suing the city of West Fargo for using its Public Works Department to complete parts of a street paving project and not following the proper bidding process for public construction projects.

According to a complaint filed May 22 in Cass County district court, the Associated General Contractors of North Dakota and American Concrete Pavement Association, North Dakota Chapter Inc. say the city violated public bidding statutes by not properly advertising project No. 2290, a $1.3 million mill and overlay street project. The associations, whose members are local contractors, claim the city has no authority to "self-perform" any part of a public project that costs more than $200,000, court documents said.
