CLEVELAND, Ohio— A federal magistrate judge has tossed out a lawsuit filed by a man acquitted of aggravated burglary charges.

Vincent Ealom accused University Circle police of wrongful prosecution for pursuing criminal charges against him. He also alleged a security company violated his rights by holding him until police arrived.

U.S. District Magistrate Judge Jonathan Greenberg ruled last month that Judson Park security guards weren’t acting as police officers during the incident and that a Cuyahoga County grand jury found probable cause for the charges, negating Ealom’s legal claims.

Cleveland.com and The Plain Dealer reached out to University Circle police attorney James Climer and Ealom’s attorney Mark Kaiser for comment.

Ealom had sought $1 million in damages.
