Neil Barry, a former NWT teacher recently convicted of sexual assault against two teenage boys under his supervision between 2006 and 2011, has been granted release until his appeal is concluded.

On May 10, a jury found Barry, 48, guilty of sexual assault and sexual exploitation of two teen boys. On Sept. 10, a Supreme Court judge sentenced him to nine years in prison.

Barry has no prior criminal record and has been free, without apparent incident, for close to four years, Court of Appeal justice Jane Fagnan noted while assessing the appeal. Barry lives in Prince Edward Island and is agreeable to posting $30,000 to assure that he is present for his future court dates.

He maintains his innocence and is arguing that the jury was not properly instructed on how to consider certain evidence
