BOISE, Idaho — An Idaho inmate on Friday was sentenced to an additional 40 years in prison after a judge found him guilty of battery with intent to commit murder.
On Friday, Oct. 3, Ada County District Judge Peter Barton sentenced Daniel J. Gilmartin to 40 years in prison with 20 years fixed for an attack that took place in an Idaho correctional facility.
Gilmartin was in prison due to a prior conviction of grand theft in Bingham County, the Ada County Prosecutor's Office said.
While in prison, court documents allege that he "struck another inmate in the head with a rock, causing serious injuries."
The 34-year-old previously pleaded guilty to the charge of battery with intent to commit murder, in addition to a sentencing enhancement for the infliction of great bodily injury and fo
