A mother’s conviction by a Luzerne County jury in the death of her 16-day old daughter by feeding her breast milk contaminated with fentanyl was upheld on appeal.
A three-member panel of the Pennsylvania Superior Court last week rejected the appeal by Jennifer Travinski, 48, whose conviction of third-degree murder related to the death of Ayra Travinski on Nov. 28, 2021, was the first in Pennsylvania involving infants’ deaths involving breast milk tainted with illicit drugs.
Similar infant deaths by drug laced breast milk in Pennsylvania have involved manslaughter convictions or guilty pleas.
Travinski, through her appellate attorney, Robert M. Buttner, challenged the jury’s guilty verdicts claiming the evidence did not rise to the level of third-degree murder.
