A group of Strip District business owners who are suing the Department of Mobility and Infrastructure will still have to pay a bond to temporarily prevent the city from reducing Penn Avenue to one lane between 22nd and 31st streets, per a court order Wednesday morning.

Common Pleas Judge Alan Hertzberg lowered the Strip District Business Association’s bond amount to $39,749 — a sizable reduction from the $112,000 DOMI estimated that it would incur in damages if work suddenly stopped on the project, which began late last month.

But the Business Association’s attorney, John A. Daller, of New Castle, had requested the court to reduce the bond to a “nominal” amount on Oct. 3.
