Prosecutors are not seeking the death penalty against al-Muhtadi.
An FBI affidavit presented in federal court on Oct. 17 accuses al-Muhtadi of gathering armed men in Gaza shortly after the Oct. 7, 2023, Hamas attack on Israel began, then crossing the border to participate in the attack where children, men and women were killed, some tortured, and some taken hostage.
The FBI based its report on interviews, cell phone tower pings and emails and was aided by Israel.
