New Mexico Attorney General Raul Torrez has joined attorney generals in other states in filing a lawsuit against the U.S. Department of Agriculture over the Supplemental Nutrition Assistance Program .

The attorney general's office says the USDA told states in a letter there would be insufficient funds to pay for SNAP benefits nationwide .

The office says that while the USDA claims there are insufficient funds, there is access to a contingency fund that was appropriated by Congress that the USDA could use.

The attorney general's office says they will be filing a restraining order to ask the court to reinstate SNAP benefits.
