The City of Scottsdale can continue collecting and spending money raised from ballot Proposition 490.

Maricopa County Superior Court Judge Adele Ponce dismissed the Goldwater Institute’s lawsuit against the city, seeking to stop it from collecting and spending funds from the ballot measure to pay for maintenance at the city’s 44 parks, maintenance and personnel (such as more rangers) in the McDowell Sonoran Preserve and capital improvements at WestWorld of Scottsdale.

“The City of Scottsdale is pleased with the court’s decision to dismiss all claims in the Stamper case,” interim city attorney Luis Santaella said in an email to the Independent. “The ruling supports the city’s position that Proposition 490 was lawfully approved by voters and is consistent with the Arizona Constitution.
