HENDERSON, Ky. (WEHT) -- A dispute between Spencer County residents and Grandview Solar was heard Thursday at the Indiana Supreme Court.
The case centers on whether Grandview's board of zoning appeals had the authority to grant a special use exception for land outside town limits.
In 2019, Grandview Solar received the special exception to build a solar farm. Some residents sued, saying the special exception was invalid from the very beginning. The residents oppose the project, citing concerns over farmland loss and declining property values.
"This dispute should have died within 30 days of the Board of Zoning Appeals decision in 2019,” attorney Margaret Christensen said. “Instead, the project opponents tried to revive the dead more than four years later."
