BAKERSFIELD, Calif. (KGET) -- The man accused of killing an 8-year-old boy, while driving drunk was shown to have a blood alcohol content more than four times the legal limit.

The driver answered to murder and DUI charges in court on Wednesday.

Bakersfield police say Serna was drunk when he swerved off California Avenue in his black Nissan Titan into a parking lot where a taco truck was open for lunch.

Police say he crashed through the three fences, a metal tent, a power pole, and a boy along with his father who were sitting at a picnic table having lunch.

The 8-year-old was rushed to Kern Medical, then to Valley Children's hospital in Madera, but the best doctors could not save his life.

He died Tuesday morning.

He was identified as Xxavien Alvarez Hernandez.
