RALEIGH, N.C. — A man accused of shooting and killing an officer at WakeMed Garner made his first appearance in court on Monday, according to CBS affiliate WNCN.
Benji Martin Jr., 29, appeared for less than two minutes, where the judge read his charges and agreed to continue the case until Dec. 15, according to WNCN.
If convicted, Martin Jr. would face life in prison or the death penalty.
Officer Roger Smith, 59, was shot and killed in a struggle with Martin Jr. on Nov. 8, according to the Garner Police Department.
The shooting happened in the lobby of WakeMed Garner Healthplex along US 70.
Martin Jr. has been charged with murder, according to police.
