CHARLESTON, W.Va. — The Supreme Court of Appeals of West Virginia on Tuesday granted an expedited motion to stay all further proceedings and the enforcement of a permanent injunction issued by a Raleigh County Circuit Court in a vaccine exemption case.
The high court's order effectively pauses the enforcement of the circuit court's Nov. 26 ruling, which would allow for students involved in the case to receive religious exemptions to the state's mandatory student vaccination law.
The petitioners in the case — including the West Virginia and Raleigh County boards of education — had filed a writ of prohibition challenging a lower court decision to establish a statewide class action certification in this case. The stay will remain in place pending the resolution of this writ of probation.
