The statement, which was made on social media in November 2023 was flagged by the force as a non-crime 'hate incident’ (NCHI).
Now, the police say that Fraser’s case was dealt with differently to “reported incidents involving other prominent public figures", but contend it was legal to flag it as such.
Commenting on the Scottish Government’s Non-Binary Equality Action Plan, Fraser posted: "Choosing to identify as 'non-binary' is as valid as choosing to identify as a cat.
"I'm not sure governments should be spending time on action plans for either."
Following a complaint from a member of the public, the force investigated and found it was not a crime.
