A federal judge in Little Rock is temporarily stopping the state from enforcing a law giving family members of a deceased person the ability to halt organ donations.
U.S. District Judge James Moody on Monday ruled that plaintiffs challenging Act 861 , the Arkansas Revised Anatomical Gift Act, are likely to succeed in their attack on the statute that was scheduled to take effect Tuesday.
After a 45-minute hearing, Moody concluded the law was likely invalid because it is vague and violates the due process rights of family members. He said not stopping enforcement could cause irreparable harm.
"The government will suffer no harm or adverse consequences," Moody said.
