HENRY COUNTY, Ga. — The Georgia Supreme Court will not hear the appeal of a man convicted of second degree murder in the 2019 death of a 2-year-old foster child under his care.

The state Supreme Court released several cases for which it denied cert — a hearing of appeal — on Tuesday, and among them was that of Joseph Rosenbaum.

Rosenbaum, along with his wife Jennifer Rosenbaum, were found guilty six years ago of murder and other charges in the 2015 death of 2-year-old Laila Daniel.

The Rosenbaums had claimed she choked on a piece of chicken, but a evidence — including from the GBI medical examiner — countered that contention and a jury heard from first responders said they could not recall an obstruction
