In reality, the order seeks to prosecute flag burning under existing laws in a way that could invite a fresh legal battle over First Amendment protections.

The official White House post quickly drew pushback. Twitter users added a community note clarifying that the Supreme Court ruled in Texas v. Johnson (1989) that flag burning constitutes symbolic speech protected by the First Amendment.
