The Alabama Supreme Court has affirmed the dismissal of a lawsuit filed by the city of Birmingham against Jefferson County Sheriff Mark Pettway.
The suit, filed in February 2024 , claimed that the sheriff was obligated to house people arrested by the city in the Jefferson County Jail, even if they did not have a valid warrant.

The city and county originally had a memorandum of understanding in late 2023, under which the county would temporarily house city inmates after they were arrested; however, this agreement was later terminated due to a disagreement over terms between the two parties.
