BRANSON, Mo. — A company has been awarded $30 million following a constitutional property-rights case against the City of Branson.
According to an Ashe Law, LLC press release, a Taney County jury awarded Cushman Properties, LLC, a family-owned company led by Duvid Cushman and his sons James and Andrew, following a dispute over the city's failure to provide adequate water service.
The business owned by the Cusman's is located on a 292-acre property at the corner of Highway 76 and Highway 376, which has been owned since the 1940s.
"When the City annexed the property in 2001, it agreed to provide a supply of water suitable for fire protection and commercial development,” attorney Ric Ashe, who represented the Cushman family, said in the release. “That promise was made in exchange for David
