EVANSVILLE, Ind. (WFIE) - An insurance company is suing the City of Evansville around a year after a fire rekindled at a downtown restaurant, causing thousands of dollars in damage.
In the lawsuit, Illinois Casualty Company alleges the Evansville Fire Department failed to fully put out a fire at Madeleine’s Fusion Restaurant on December 26, 2024.
The insurance company says the damage caused by the rekindled fire led to them having to pay out more than $1.2 million.
“The City’s fire department breached its duty, and was negligent, when it erroneously determined that the fire had been distinguished [sic] and chose to end the fire suppression efforts and leave the fire scene,” says the plaintiff in the lawsuit.
We’ve reached out to city officials and have been told they won’t comment
