Sammy Stein’s article on whether Israel has committed genocide in Gaza ("Why calling Gaza a genocide is legally wrong and morally reckless", The Herald, December 1) argues that the term is being misused without legal or factual basis. Yet the very institutions the article invokes say otherwise.
In January 2024, the International Court of Justice found that at least some of South Africa’s genocide claims raised plausible rights, including that Palestinians in Gaza have a plausible right to protection from genocide. On that basis, it issued repeated provisional measures. This is not a court indulging protest rhetoric.
