THE recent employment tribunal involving Sandie Peggie (pictured) and Dr Beth Upton has already been claimed as vindication for whichever side of the “gender debate” one happens to favour.
This reaction is not only premature; it entirely misses the point the judgment actually exposes.
The tribunal did not uphold Peggie’s allegations against her trans colleague. It found that NHS Fife harassed Peggie through its mishandling of her complaint – an institutional failure, not a cultural one.
Yet it is equally clear that Dr Upton suffered distress and reputational harm through that same mishandling.
In other words, the health board managed to fail both staff members by allowing a clash of needs, perceptions, and anxieties to metastasise into a polarised dispute.
